FTC Announces Rule Banning Noncompetes

On April 23, 2024, the Federal Trade Commission (FTC) issued a final rule in which new noncompete agreements are banned for many employees. Existing noncompete agreements for senior executives, representing less than 1% of all workers, will be allowed to remain in effect, but existing noncompete agreements for non-senior executives will no longer be valid once this rule goes into effect later this year. Details can be found in this Fact Sheet published by the FTC. This will take effect 120 days after the final rule is published in the Federal Register. The Academy had previously submitted comments to the FTC about the negative impacts of noncompete agreements and will be analyzing this rule to determine how it will impact PM&R physicians once it is implemented.

    Legislation Introduced to Alleviate Impact of Conversion Factor Cut for 2021

    Last month, two bills were introduced in the House proposing solutions to the estimated 10.6% Physician Fee Schedule conversion factor cut expected to go into effect January 1, 2021.  The bills offer some relief to the cut, but do not reflect a comprehensive or long-term solution.  AAPM&R has therefore chosen to remain neutral regarding these bills.
